Terms and Conditions

1. Definitions

• Platform — the website, application, and services provided by WorkHub Today.
• Employer — any legal entity or natural person acting in the exercise of a profession or business who uses the Platform to post vacancies and recruit candidates.
• Job Seeker — any natural person who uses the Platform to search for employment and vacancies.
• Match — the moment when both an Employer and a Job Seeker have indicated a mutual interest in each other via the swipe mechanism.
• Content — all text, information, data, photos, and videos uploaded to the Platform by its users.

2. Operation of the Platform

• WorkHub Today acts solely as an online matchmaking platform where Employers and Job Seekers can easily and quickly connect using a swipe mechanism.
• The Platform uses general information publicly available on the internet, supplemented by the information and Content added explicitly by the Employers and Job Seekers themselves.
• Job seekers have the option to use an incognito mode. This keeps their personal identity data hidden from employers until a match is established, the job seeker explicitly chooses to reveal it, or the employer pays to unlock their identity.

3. Fees and Payment (No Cure, No Pay)

For Job Seekers

• Matching is entirely free of charge.

For Employers

• The Platform operates on a 'No Cure, No Pay' basis for Employers. Creating an account and swiping through candidates is free.
• Upon a mutual Match, the Employer owes a one-time fixed fee (the "Fee") to WorkHub Today.
• Once this Fee is paid, the chat function is unlocked, allowing both parties to communicate directly to schedule an appointment.

Refund Policy

If the Job Seeker fails to respond in any way to the Employer's contact attempts within 14 days following the Match (and after the Fee has been paid), the Employer is entitled to a full refund of the paid Fee. To claim a refund, the Employer must submit a request through the Platform's official support channels.

4. Intellectual Property and Content

1. Ownership — all Content (including profile text, multiple photos, and introduction videos) uploaded to the Platform by Job Seekers or Employers remains the sole property of the respective user at all times.
2. Limited License — users grant WorkHub Today a royalty-free, worldwide license to display their Content on the Platform, solely for the purpose for which the Platform is intended: establishing a job match.
3. WorkHub Today will not use or exploit uploaded photos, videos, or profile content in any way other than for the aforementioned matching purposes.
4. Users are strictly prohibited from uploading Content that infringes on third-party rights, is offensive, or violates any applicable laws.

5. Privacy and GDPR / UK GDPR Compliance

1. WorkHub Today processes personal data in strict compliance with the General Data Protection Regulation (GDPR) and the UK GDPR.
2. In accordance with GDPR rules, all relevant personal information and Content will be permanently deleted upon the user's explicit request.
3. WorkHub Today collects general, anonymized data to analyze and improve the functionality of the platform.

6. Limitation of Liability

1. WorkHub Today only has an obligation of means to bring Employers and Job Seekers together via the Platform. We do not guarantee the success of a Match, the accuracy of user profiles, or the suitability of a candidate or vacancy.
2. Once parties (Employer and Job Seeker) have entered into contact following a Match, WorkHub Today holds no liability whatsoever for subsequent interactions, interview outcomes, the accuracy of information exchanged, or any employment contracts resulting from the match.
3. WorkHub Today is not liable for indirect damages, loss of profit, missed savings, or damages resulting from business interruption.
4. The total liability of WorkHub Today towards an Employer, on any legal grounds whatsoever, is at all times limited to the total amount of the one-time Fee paid for the specific Match in question.

7. Account Termination and Deletion

1. Both Job Seekers and Employers have the right to terminate or delete their account at any given time.
2. WorkHub Today reserves the right to suspend or permanently delete the accounts of users who violate these Terms, applicable laws, or public decency, immediately and without prior notice.

8. Governing Law and Jurisdiction

1. These Terms and all agreements between WorkHub Today and its users are governed by Dutch law (as the country of establishment of Cre8tive-online), unless mandatory consumer protection laws in the EU or the UK dictate otherwise for Job Seekers.
2. Any disputes arising out of or in connection with these Terms shall initially be submitted to the competent court in the district where Cre8tive-online is statutorily established, unless applicable law mandatorily designates another court.
